Can I keep my insurance at my civilian job when I get called up?
For the first 30 days your insurance from your civilian job continues as usual. The Uniformed Services Employment and Re-employment Rights Act of 1994 (USERRA) protects you for tours of 31 days or more by allowing you to keep your employer's health insurance for up to 18 months.
To make sure you're protected by the USERRA, notify your employer of your call to active duty as soon as possible. The USERRA also requires you to return to work within a certain time period, depending upon when your active duty status ends.
-
After 1 to 30 days of active duty, you must return to work on your next regularly scheduled workday after your active duty status ends.
-
After 31 to 180 days, you must return to work no later than 14 days after your active duty status ends.
-
After 181 or more days, you must return to work no later than 90 days after your active duty status ends.
